KAI Terms and Conditions

KickAss Products provides an AI-powered chatbot called KAI. KAI is designed to help customers and website visitors find information on the KickAss Products website, explore products, access support information, and better understand our range of 12V, camping and off-grid adventure products.

These Terms and Conditions apply whenever you use or interact with KAI. By starting or continuing a conversation with KAI, you agree to be bound by these Terms and Conditions.

In these Terms and Conditions, references to KickAss Products, KickAss, we, us or our mean KickAss Products Pty Ltd. References to you or your mean any person who uses or interacts with KAI, whether as a guest user, logged-in customer, website visitor or account holder.

What KAI Is Intended For

KAI is provided to assist with general customer enquiries and website navigation. It may help you:

  • find KickAss products and product categories;
  • compare product features and general specifications;
  • locate support content, manuals, guides and FAQs;
  • understand general 12V, solar, battery, inverter, camping and off-grid setup concepts;
  • check product information, promotions or availability where that information is accessible;
  • connect with relevant KickAss support or sales channels.

KAI must only be used for these general customer support, product discovery and website assistance purposes. This is the Permitted Purpose.

Your use of KAI is optional. KickAss Products does not pay, reward or reimburse you for using KAI, and you are responsible for any purchasing decisions or expenses you choose to make after interacting with KAI.

AI-Generated Responses

KAI uses generative artificial intelligence. Although KAI may respond in a conversational way, its responses are generated by AI and should not be treated as statements made directly by a KickAss team member.

KAI is a digital assistance tool. It is not a substitute for speaking with our customer support team, reading the relevant product manual, checking product specifications, or obtaining advice from a suitably qualified professional.

Your Right to Use KAI

KickAss Products grants you a limited, revocable, non-exclusive and non-transferable right to use KAI for the Permitted Purpose.

You must not:

  • use KAI in a way that is unlawful, abusive, misleading, discriminatory, defamatory, threatening, offensive or harmful;
  • attempt to disrupt, damage, overload, manipulate or interfere with KAI, the KickAss Products website, or any related systems;
  • upload, submit or transmit malware, viruses, harmful code or any material that may compromise KAI or our systems;
  • copy, scrape, modify, reverse engineer, decompile or attempt to extract the underlying software, models, prompts, source code or system logic used by KAI;
  • use KAI to infringe another person’s rights, including privacy, confidentiality or intellectual property rights;
  • allow another person to use KAI through your KickAss account without authorisation;
  • use KAI for automated, high-volume, fraudulent, competitive or non-customer-related purposes.

Your Inputs

You are responsible for anything you submit to KAI, including questions, prompts, messages, files, images, product details, vehicle information, setup requirements and any other material you provide. This is referred to as Input.

You must ensure your Input is accurate, lawful and does not breach these Terms and Conditions or the rights of any other person.

Please do not submit passwords, payment card details, confidential business information, sensitive personal information, health information, private information about another person, or copyright-protected material unless you have the legal right to provide it.

Information We May Collect

When you interact with KAI, KickAss Products may collect and store information relating to that interaction. This may include:

  • your questions, prompts and messages;
  • KAI’s responses;
  • links, products or recommendations shown to you;
  • links or suggestions you click;
  • technical information such as device, browser, session or IP-related data;
  • account-related information where you are logged into a KickAss account.

Any personal information collected through your use of KAI will be handled in accordance with the KickAss Products Privacy Policy.

How We May Use KAI Data

Information collected from KAI interactions may be used by KickAss Products to:

  • respond to your enquiries and provide relevant information;
  • help customers find suitable products, support content and website pages;
  • monitor, test, maintain and improve KAI;
  • identify common customer questions, website issues or product information gaps;
  • provide customer support and resolve issues;
  • improve our products, services, support content and customer experience;
  • detect misuse, security risks, technical problems or unlawful activity;
  • comply with legal, regulatory and operational requirements.

Unless we state otherwise, customer Inputs submitted to KAI are not used by KickAss Products to train third-party large language models.

Logged-In and Guest Users

KAI may be available to both guest users and logged-in users. If you are logged into your KickAss account while using KAI, your interaction may be associated with your account and other technical identifiers.

If you use KAI as a guest, your interaction may still be associated with technical information such as your session, browser, device or IP address.

If you do not use KAI, KickAss Products will not create a KAI conversation record for you.

Storage and Retention

KickAss Products may securely store KAI conversation data, technical logs and related interaction records.

We may retain KAI data for as long as reasonably required for customer support, quality assurance, analytics, technical troubleshooting, safety monitoring, security, legal compliance, operational purposes and service improvement.

Where chat history functionality is available, you may be able to access previous KAI conversations for a limited period. You may also be able to delete some chat history where that feature is supported.

Deleting chat history from your view may not immediately remove all records already collected or retained by KickAss Products, including records required for legal, security, technical, audit or operational purposes.

Product, Technical and Setup Information

KAI may provide general information about KickAss products and related topics, including batteries, solar panels, DC-DC chargers, inverters, portable power stations, 12V systems, camping gear, vehicle setups and off-grid power systems.

This information is general only. It is not professional, technical, electrical, installation, engineering, safety or vehicle-specific advice.

Before purchasing, installing, wiring, connecting or using any product, you should check the relevant product page, specifications, user manual, safety instructions, warranty information and installation requirements.

Pricing, Promotions and Availability

Any pricing, discount, promotion, bundle, gift-with-purchase, stock or availability information provided by KAI is general and may change without notice.

Information provided by KAI does not constitute a formal quote, offer, guarantee or commitment by KickAss Products.

Final pricing, promotions, shipping costs, stock availability and product availability should be confirmed on the KickAss Products website, at a KickAss store, through our customer support team, or through another official KickAss sales channel.

Accuracy of Information

KAI may not always have access to the latest product data, stock levels, promotions, technical updates, manuals, support articles or website changes.

Information provided by KAI may be incorrect, incomplete, outdated or unsuitable for your circumstances.

You should verify important information before relying on it, including by checking official KickAss Products pages, manuals, specifications, policies, support resources or by contacting our team.

Third-Party Links and Content

KAI may provide links to third-party websites or refer to third-party information. These links and references are provided for convenience only.

KickAss Products does not control third-party websites and is not responsible for their content, accuracy, availability, security, privacy practices or terms of use.

Feedback About KAI

You may provide feedback, suggestions, comments, ideas or recommendations about KAI. This is referred to as Feedback.

You agree that KickAss Products may use, copy, modify, develop, commercialise and otherwise exploit Feedback for any purpose, including improving KAI, our website, our products, our support content and our customer experience, without payment or obligation to you.

To the extent any intellectual property rights exist in your Feedback, you assign those rights to KickAss Products.

No Warranty About KAI Outputs

To the maximum extent permitted by law, KAI is provided on an “as is” and “as available” basis.

KickAss Products does not guarantee that KAI, or any response generated by KAI, will be accurate, complete, current, reliable, uninterrupted, secure, error-free, suitable for your needs or free from viruses or defects.

KAI is an evolving tool and may be powered by third-party AI models, software and systems. It may produce responses that are inaccurate, incomplete, misleading, irrelevant, outdated or inconsistent with KickAss Products’ views, values, policies or official product information.

You use KAI and rely on any information provided by KAI at your own risk.

Australian Consumer Law

Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot be excluded, restricted or modified under the Australian Consumer Law.

To the maximum extent permitted by law, KickAss Products’ liability in connection with KAI is limited to the rights and remedies available under the Australian Consumer Law.

To the maximum extent permitted by law, KickAss Products is not liable for any loss, damage, cost, expense, claim or consequence arising from your use of KAI, your reliance on KAI, any inaccurate or incomplete response, any technical issue, or any third-party link or content provided through KAI.

Suspension or Termination

KickAss Products may suspend, restrict, withdraw or terminate your access to KAI at any time, including where we reasonably believe you have misused KAI, breached these Terms and Conditions, created a security risk, or used KAI in a way that may harm KickAss Products, our customers, our systems or any other person.

We may also modify, pause, replace or discontinue KAI, or any part of KAI, at any time.

When your access to KAI ends, your right to use KAI also ends. Any terms that are intended to continue, or that by their nature should continue, will survive termination.

Changes to These Terms

KickAss Products may update these Terms and Conditions from time to time. Updated terms will apply from the time they are published or otherwise made available.

If you continue to use KAI after the Terms and Conditions are updated, you will be taken to have accepted the updated terms.

Other KickAss Policies

Your use of KAI may also be governed by other KickAss Products terms, policies and notices, including our Website Terms, Privacy Policy, Warranty Policy, Returns Policy and any other applicable policies published by KickAss Products.

Governing Law

These Terms and Conditions are governed by the laws of Queensland, Australia.

Any dispute relating to these Terms and Conditions or your use of KAI will be dealt with in accordance with the laws of Queensland, Australia.
