Rights to Content

1. Distribution Rights: KickAss Products shall have the irrevocable right to distribute any content provided by yourself or any and all of your dependents through this submission in conjunction with these terms both domestically and worldwide, where it shall remain thereafter.
2. Ownership: KickAss Products shall own all rights to any submission in perpetuity. By submitting your photograph to this link, you agree that all ownership of copyright in the material supplied in conjunction with these terms shall remain with KickAss Products exclusively. You agree that no remuneration shall be provided in conjunction with your submission.

Waiver of Rights

1. Inspection and Approval: By submitting your photograph through this link, you hereby agree to waive any right to inspect or approve the finished product, including but not limited to any written copy that may be created in connection therewith or the use to which it may be applied. You acknowledge that KickAss Products is under no obligation to use your submission.

Acceptance of Terms

1. Agreement to Terms: By submitting a photograph through this link, you warrant that you have read these terms and conditions and that your submission deems acceptance of these Terms and Conditions.

Indemnity

1. Indemnification: To the maximum extent by law, you agree to indemnify and hold KickAss Products and its successors, assigns, and licensees harmless from and against all actions, proceedings, suits, claims, or demands brought or made against any of them, and from and against any damage, loss, cost, or expenses (including reasonable legal expenses as between solicitor and client) suffered or incurred by any of them, arising directly or indirectly from or in consequence of any breach of your representations as set out in these terms.

Eligibility

1. Entry Period: The competition closes on January 31st 2025. Entries submitted after this date will not be eligible for the prize draw.

Submission Requirements

1. Original Content: All photographs submitted must be original content created by the participant.
2. KickAss Gear: The photograph must prominently feature KickAss gear.
3. Format: Submit your photo in JPG or PNG format.
4. Size: Ensure the photo is high resolution, with a minimum size of 1MB and a maximum size of 10MB.

6. Form Submission: Complete all required fields in the submission form accurately.

Judging Criteria

1. Creativity and Originality: The uniqueness and inventiveness of the rig setup and how KickAss gear is utilized.
2. Visual Appeal: The overall aesthetic quality and composition of the photograph.
3. Storytelling: How well the caption and photo together convey the use and benefits of KickAss gear.
4. Relevance: The extent to which KickAss gear is featured and integrated into your setup.
5. Engagement: For the Fan Favourite prize, the number of likes, shares, and comments on social media posts tagged with #KickAssSetup will be considered.

Official Rules

1. Sponsor: The KickAss Camping Setup Photo Contest (the "Contest") is sponsored by KickAss Products Pty Ltd, 39 Iris Place, Acacia Ridge, QLD (the “Sponsor”). The Sponsor is responsible for all aspects of the Contest. Participation in the Contest constitutes the participant's full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Contest.
2. Eligibility: The Contest is only open to participants who are legal residents of Australia, and who are 18+ at the time of entry (the “Entrant”). Employees of KickAss Products Pty Ltd, their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers, and their immediate family members and/or those living in the same household are not eligible to participate in the Contest. The Contest is subject to all applicable federal, state, and local laws and regulations. Void where prohibited or restricted by law, rule, or regulation.
3. Contest Period: Entries will be accepted online starting on Jan 6, 2025 at 12:00 AM and ending Jan 31, 2025 at 11:59 PM (the “Entry Period”). All online entries must be received by Jan 31, 2025 at 11:59 PM. All times are (GMT+10:00) Brisbane. Entries submitted before or after the Entry Period will not be eligible. Sponsor’s computer is the official timekeeping device for the Contest.
4. How to Enter: The Contest must be entered by submitting an entry using the online form provided on this site. The entry must fulfill all Contest requirements, as specified, to be eligible to win a prize. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of KickAss Products Pty Ltd. You may enter only once and you must fill in the information requested. You may not enter more times than indicated by using multiple e-mail addresses, identities, or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of KickAss Products Pty Ltd.

7. Prizes: The approximate retail value of all prizes is $1899.70.

Winner Notification: Winners of the Contest will be notified via e-mail or phone to the e-mail address or phone number they entered into the Contest within five (5) days following the winner selection. KickAss Products Pty Ltd shall have no liability for a winner's failure to receive notices due to winners' spam, junk e-mail, or other security settings or for winners' provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 15 days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, the prize may be forfeited and an alternate winner selected. The receipt by the winner of the prize offered in this Contest is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS WINNER OF THE CONTEST AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

Terms: KickAss Products Pty Ltd reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Contest should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud, or other causes beyond its control corrupt or affect the administration, security, fairness, or proper conduct of the Contest. In such case, KickAss Products Pty Ltd may judge submissions from all eligible entries received prior to and/or after (if appropriate) the action taken by KickAss Products Pty Ltd. KickAss Products Pty Ltd reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest or website or violates these Terms & Conditions.

Limitation of Liability: By entering, you agree to release and hold harmless KickAss Products Pty Ltd and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant's participation in the contest and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware, or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Contest; (v) electronic or human error which may occur in the administration of the Contest or the processing of entries.
12. Disputes: THIS CONTEST IS GOVERNED BY THE LAWS OF QUEENSLAND AUSTRALIA. As a condition of participating in this Contest, the participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Queensland having jurisdiction. Further, in any such dispute, under no circumstances will the participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than the participant's actual out-of-pocket expenses (i.e., costs associated with entering this Contest), and the participant further waives all rights to have damages multiplied or increased.
